                                                                Sample Agreement 2013

Received from ____________________________ Phone# ______________________the sum of $420.00, representing a non-refundable binder of this contract for the rental of the apartment at ________., Troy NY 12180 for the period of June 1, 2013 to May 31, 2014.  After all payments are made the $420.00 binder becomes the security deposit, which is in addition to the total price.  The total price for this period is $5040.00 that covers the use of the apartment facilities and the room, including water, garbage and recycling fees, gas and normal electric usage with the exception of telephones and air-conditioners. The above rate is based on occupancy of 3.  A default payment of one or more will increase the remaining tenant rates proportionally.  It is agreed that the only persons allowed to occupy this apartment are the tenants on the lease.

Payment is to be made as follows: $840.00 on April 15, 2013, $840.00 on June 15, 2013, $840.00 on August 15, 2013, $840.00 on October 15, 2013, $840.00 on December 15, 2013, $840.00 on or before February 15, 2014.  The damage deposit is fully refundable if the apartment is left in clean, undamaged condition and all furnishings are returned to their original locations.

It is hereby agreed that no refund will be given.  Should any or all tenants vacate the apartment before or after all payments have been made the obligation to find a replacement suitable to the other occupants and the owner is the responsibility of the above person.  If no effort is made and no one is found to fill the vacancy no refund of unused time will be made.

It is further agreed that the room and the other facilities will be maintained in clean, orderly and undamaged condition.  Damages not corrected will be repaired and tenants will be billed if damages are attributable to tenant neglect. The tenants agree to keep the apartment clean and orderly, particularly during the period it is being shown to prospective tenants, or pay the cost for cleaning.  All apartments must be thoroughly cleaned upon leaving and furniture returned to original locations (stove and oven cleaned; refrigerator cleaned and defrosted; baseboard, floors and walls cleaned, rugs cleaned).  Incursions into walls with screws and nails are not allowed.  Painting, alteration or removal of furnishings is not allowed without prior written approval of the owner. All unauthorized alterations or removal will be chargeable to all tenants unless settled individually. No pets are allowed. Anything flammable, whatsoever, is prohibited on or near the property.  Tenants acknowledge responsibility to check smoke detector monthly and report any problems in its function.  It is agreed that tenants will be responsible for snow and ice removal from steps and walkways near the entrance to their premises.  The owner will provide lawn cutting and landscaping services as needed.  It is agreed that tenants will properly store trash outside and to weekly bring all thrash to the curb according to city requirements.  Noise that intrudes to bordering apartments or homes is prohibited from 10 pm – 8 am.

Renewal of the lease should be at your groups earliest convenience.

Subletting is allowed only with the owner’s permission and a signed agreement between tenant, subleasor and the owner, accompanied by the payment of security deposit ($420.00) to the owner.

Owner must have keys to all rooms and apartments as required.  Access will be allowed on an as needed basis.  It is agreed that all problems be reported promptly so that costly repairs and inconvenience can be minimized.
